If you have a health concern, including a suspected allergic reaction, consult a qualified healthcare professional. Violation of this section is grounds for immediate termination of your access to the Site.

SoleHustle™, the SoleHustle™ logo, packaging, product designs, photographs, graphics, website content, and all related branding are the property of SoleHustle™ and/or its licensors and are protected by copyright, trademark, and other intellectual property laws. Except as necessary to use the Site for its intended purpose (e.g., browsing and purchasing Products), you may not copy, reproduce, modify, distribute, publish, or create derivative works from any Content on the Site without our prior written permission.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your own personal shopping purposes, subject to these Terms.

7. User Submissions

Pricing. All prices are listed in U.S. Dollars unless otherwise stated and are subject to change without notice. We make reasonable efforts to display accurate pricing, but errors may occasionally occur; if we discover a pricing error on an order you've placed, we will contact you with the corrected price or cancel the order and issue a refund.

Taxes. Applicable sales tax will be calculated based on your shipping address and added to your order total at checkout.

Product Availability. Products may be discontinued, limited in quantity, or placed on backorder at our discretion. We reserve the right to limit the quantity of Products purchased per customer or per order.

9. Payment

10. Shipping and Delivery

We will ship your order to the address you provide at checkout. Shipping times displayed on the Site are estimates only; actual delivery dates may vary due to carrier delays, weather, or other factors outside our control. Risk of loss and title to Products pass to you upon our delivery of the Product to the shipping carrier.

TO THE FULLEST EXTENT PERMITTED BY LAW, SOLEHUSTLE, ITS OWNERS, EMPLOYEES, AND AGENTS (TOGETHER, THE "SOLEHUSTLE PARTIES") WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE TOTAL LIABILITY OF THE SOLEHUSTLE PARTIES ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR PURCHASE OF ANY PRODUCT EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100) OR (B) THE AMOUNT YOU ACTUALLY PAID TO SOLEHUSTLE FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THIS TYPE OF LIMITATION, SO IT MAY NOT APPLY TO YOU.

15. Indemnification

You agree to indemnify and hold harmless the SoleHustle Parties from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Site, (b) your use or misuse of any Product, or (c) your violation of these Terms.

17. Dispute Resolution — Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

a. Agreement to Arbitrate. You and SoleHustle agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any Product (a "Dispute") will be resolved through final and binding individual arbitration, rather than in court, except as set forth below. The Federal Arbitration Act governs the interpretation and enforcement of this provision.

b. Class Action Waiver. You and SoleHustle each agree that any arbitration will be conducted only on an individual basis and not as a class, collective, or representative action.

c. Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive relief in court to prevent infringement or misuse of intellectual property. Nothing here prevents you from filing a complaint with a government agency.

d. Informal Resolution First. Before starting arbitration, you agree to first contact us at solehustleofficial@gmail.com and attempt in good faith to resolve the Dispute informally for at least 30 days.

e. Opt-Out. You may opt out of this arbitration agreement by emailing solehustleofficial@gmail.com with the subject line "ARBITRATION OPT-OUT" within 30 days of first accepting these Terms. If you opt out, neither you nor SoleHustle will be bound by this Section 17.

18. Termination

We may suspend or terminate your access to the Site at any time, for any reason, including a violation of these Terms. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

19. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right under these Terms is not a waiver of that right. These Terms, together with our Product Disclaimer and Privacy Policy, are the entire agreement between you and SoleHustle regarding your use of the Site and Products.
